Credit Report Policy & Your Information
Last Updated & Effective: March 21, 2026
1. Consent to Obtain Credit Information
By submitting your loan request or checking your rate on Orchard Key, you understand and expressly agree that you are providing written instructions and your consent under the Fair Credit Reporting Act (FCRA). You authorize Orchard Key, its network of lending partners, and its affiliates to obtain your credit report, credit score, and other related information from one or more consumer reporting agencies (such as Equifax, Experian, or TransUnion).
2. Soft Inquiries vs. Hard Inquiries
It is important to understand how we interact with your credit file to protect your financial standing:
Initial Rate Check (Soft Inquiry)
When you initially submit your information on our platform to see your loan options, we and our partners perform a "soft pull" or soft inquiry on your credit report. This type of inquiry does not impact your credit score. It is used solely to determine your initial eligibility and to present you with tailored loan offers.
Final Application (Hard Inquiry)
If you choose to proceed with a specific loan offer and formally apply with one of our lending partners, that specific lender will typically perform a "hard pull" or hard inquiry. Hard inquiries are recorded on your credit report and may temporarily affect your credit score.
3. How We Use Your Information
We are committed to data minimization. Your credit information and personal data are used strictly to:
- Verify your identity, prevent fraud, and comply with the USA PATRIOT Act.
- Assess your creditworthiness and current financial profile.
- Match you accurately with appropriate loan products, amounts, and repayment terms.
- Comply with all applicable federal and state regulatory requirements.
4. Do Not Sell or Share My Personal Information
Depending on your state of residence (such as California under the CCPA/CPRA, or states with similar privacy frameworks), you may have the legal right to direct us not to "sell" or "share" your personal information.
Orchard Key respects your privacy and operates transparently. We only share your data with necessary third-party lending partners, identity verification services, and service providers required to facilitate your specific loan request. We do not sell your personal data to unaffiliated third parties for their own marketing purposes.
If you would like to exercise your right to opt-out, access your data, or request deletion of your information, please contact us at the email address provided below or submit a formal request through our Contact Us page.
5. Accuracy of Your Information
You agree that all information you provide during the application process is accurate, current, and complete. Orchard Key relies on the accuracy of this data. We do not control the data maintained by national credit bureaus.
If you believe there are inaccuracies in your credit report, you must file a dispute directly with the relevant credit bureau (Equifax, Experian, or TransUnion). We cannot alter or amend the credit records held by these agencies.
